Terms & Conditions

Last updated: November 3, 2026

These terms apply when you use this website or book Cliff Villa with 2304322 Ontario Inc. (“we”, “us”). By completing a booking, you agree to them for yourself and for everyone in your group.

What you are booking

A booking gives you temporary exclusive use of Cliff Villa at Cliff Villa Peninsula, Watamula, Curaçao for short-stay holiday accommodation. It does not create a tenancy or any other property right. Your confirmation sets out what is included, and food, drinks and optional services are extra unless it says otherwise.

Making a booking

You must be at least 18 years old and able to enter into a contract to book. The person who books is responsible for all payments and for their group’s compliance with these terms.

Your dates are held for up to one hour while you complete checkout. Your card is then authorized for the first payment and your dates stay held while we review the booking, for up to 6 days. A contract exists only when we approve the booking and send you confirmation. We may decline a booking at our discretion, and that payment is then not charged.

Prices and payment

All prices and charges are in US dollars (USD). Your quote shows lodging, any additional guest charges, the cleaning fee, the resort fee and hospitality tax. If your bank uses another currency, it may apply its own exchange rate and fees.

  • Booking 44 days or more before arrival: 50% is charged when we approve your booking. The remaining 50% is issued 30 days before arrival and is due 2 weeks later.
  • Booking fewer than 44 days before arrival: the full total is charged when we approve your booking.

We email you a payment link and reminders for the balance. If the balance is not paid by its due date, we may cancel your booking at our discretion. This is not automatic. Stay payments you have already made are not refunded if we do.

Cancellations and changes

Our Refund and Cancellation Policy forms part of these terms and governs cancellations, date changes and refunds. Stay payments are non-refundable. Arranging travel insurance covering cancellation, medical costs and travel disruption is your responsibility.

Your stay

  • Check-in is from 3:00 p.m. and check-out is by 11:00 a.m. Other times need our prior agreement.
  • No more than 12 guests may stay overnight, and only guests included in your booking unless we agree otherwise in writing.
  • Smoking is not allowed indoors.
  • Pets are allowed only with our prior written approval.
  • Events and celebrations of 10 or more people need our prior written approval, which may carry extra conditions and charges.
  • You must respect neighbors, staff and the Watamula nature preserve, follow local law and house instructions, and not use the villa for anything illegal.

If you or your group seriously breach these terms, we may end the stay and require you to leave without a refund, to the extent the law allows.

Safety and natural surroundings

The villa stands on a cliff above open sea and has a pool, sea access, uneven natural ground and nearby wildlife. No lifeguard is provided. You use the villa, pool, courts, gym, sea access and surroundings at your own risk and must follow safety instructions. Adults must supervise children at all times, especially near the pool, cliff and sea.

Damage and belongings

Please report any damage or problem promptly so we have a chance to fix it. You are responsible for damage, loss or unusual cleaning caused by you, your group or your visitors, other than normal wear and tear. You are responsible for your own belongings. We are not liable for their loss or damage unless the law requires otherwise.

Other providers

Chefs, therapists, dive and boat operators, drivers, restaurants and other third parties are independent of us, even if we recommend them or help arrange their services. Their terms apply, and they are responsible for the services they provide.

Travel documents and legal requirements

You are responsible for your group’s passports, visas, health requirements, insurance and compliance with the entry rules of Curaçao and any other country on your route. Activities such as diving, boating and driving may have their own age, licence or medical requirements.

Website information

We try to keep descriptions, photographs, availability and prices accurate, but furnishings, facilities and surroundings can change, and errors can occur. If we find a clear pricing or availability error, we will contact you and may correct it or cancel the booking with a full refund. Blog posts and travel guides are general information only, so please check details such as opening hours and conditions yourself.

All website content belongs to us or our licensors. You may not copy it for commercial use without our permission.

Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be excluded or limited, and nothing limits consumer rights that cannot legally be excluded.

Otherwise, to the extent the law allows, we are not liable for indirect or consequential loss, or for loss of enjoyment, travel costs or lost profits, and our total liability for any booking is limited to the total amount you paid us for that booking.

Events beyond our control

We are not liable for failing to perform because of events beyond our reasonable control, such as severe weather, natural disasters, epidemics, government action, utility failures or civil unrest.

Privacy

Our Privacy Policy explains how we handle personal information.

Changes and general terms

We may update these terms from time to time. The version in effect when we confirm your booking applies to that booking unless the law requires otherwise. If any part of these terms cannot be enforced, the rest still applies. You may not transfer your booking without our written agreement.

Governing law

These terms are governed by the laws of Ontario, Canada, and disputes are subject to the jurisdiction of the courts of Ontario. This does not remove any mandatory consumer protection you have under the law of the place where you live. Please contact us first so we can try to resolve any problem directly.
